Terms and Conditions

 

These Terms and Conditions (“Terms”) applicable to the services available through gogogo.com.hk (the “Site”) and your obligation and responsibilities, and limitation of our liability. By using the Site services (the “Services”) as described below, you acknowledge that you have read and understood, and agree to be bound by these Terms. You must be at least 18 years of age to use the Services. If you do not agree with any part of the Terms, you must not use the Services of the Site.

 

The Services

 

The Services available through the Site comprise airline travel products, hotel accommodations and payment processing, documentation and ticketing services. Some of the material accessible through the Site is provided by airlines, hotels and other third party service providers (collectively as “Provider” or “Providers”). Unless a Provider has agreed otherwise, all products, services, advice, merchandise and information available through this Site are provided on an “as is”, “as available” basis without warranties of any kind, either implied or expressed. You expressly agree that the use of the Services available through the Site is at your own risk. You should make your own evaluation of the accuracy or completeness of any information, opinion, advice or other content available through the Site which does not include all travel products available in the market.

 

In addition to these Terms, Providers may impose their own terms and conditions in relation to their air, hotel or travel products (the “Product Terms”). You must accept and agree to those Product Terms to proceed with your booking transaction. Please read carefully the Product Terms before completing your booking.

We reserve the right at our sole discretion, to modify, revise, amend these Terms in part or in whole at our sole discretion from time to time and such changes shall be effective upon posting on the Site. You agree to be bound to any changes to these Terms when you use the Services after any such change is posted. Please review these Terms at regular intervals to ensure you are aware of any change.

 

Limitation of Liability

 

We act as an agent for airlines, hotels or other Providers in selling travel services, or in accepting booking transactions for such services to be provided to you. We shall not assume liability for any injury, damage, death, loss, accident or delay due to an act of negligence or the default of a Provider, or by an act of god. Moreover, we shall not accept responsibility for any damage or delay due to sickness, pilferage, labour disputes, machinery breakdown, quarantine, government restraints, weather, fire, accidents, earthquakes, riots, strikes, wars, storms, or causes beyond our control. No responsibility shall be accepted for any additional expense, omissions, delays, re-routing or acts of any government authority. The contract in use by a Provider, when issued, shall be between the Provider and the passenger, hotel guest or user of the services.

 

 

 

 

  1. Airline Ticket

 

 

 

 

  • Air Fare

 

  • Airlines provide us with the airfare and other information related to the Services. We endeavour to publish and maintain accurate airfares and information for the airline services. In the event, however, that a service is listed or provided to us at an incorrect price or with incorrect information due to typographical error or other error in pricing or service information received from an airline, we and/or the airline retain the right to refuse or cancel any requests from booking arranger, user of the Site and/or passenger (collectively as “you”) placed for such service, whether or not the order has been confirmed and/or your credit card charged. If your credit card has already been charged for the purchase and your request is cancelled because of incorrect airline information, we and/or the airline will promptly issue a credit to your credit card account in the amount of the charge. In the event that an airline publishes a fare at one price and later determines not to honour that fare at that price, we are not responsible for and cannot honour the price that was originally listed by the airline. Only the airline can determine whether or not to honour the misstated price.

 

  • All airfares and prices on this Site are quoted in Hong Kong Dollar (HKD).

 

  • Taxes and surcharges are normally included in the airfare. Any variance will need to be settled at local immigration of the country.

 

     

    • All promotional discounts cannot be used in combination with other promotions at the same time.

     

    • The airfare does not include:
    • Travel documents and visa fees;
    • Excess baggage charges;
    • Additional expenses caused by traffic delays, strikes, bad weather or any other crisis beyond our control;
    • Travel insurance.

     

     

    1.2     Service Fee

     

    Service Fees do not include any charges that may be imposed by airlines. Please refer to the conditions stated in the confirmation email for the feasibility of amendment.

    1.3     Fuel Surcharge

     

    The amount of fuel surcharge (if applicable) paid upon booking confirmation is an estimated cost only which will be subject to adjustment based on individual policies of the airlines. We shall pay you back any extra amount paid. Likewise you agree to pay for any additional amount arising out of the adjustment.

     

     

    1.4     Travel Document

     

    • Many countries require foreign nationals to hold a passport with at least 6 months validity based on the return date of travel and minimum two (2) blank pages for entry stamp.

     

    • Booking must be made under passenger’s full name in English identical with the travel document including but not limited to re-entry permit for visiting China.

     

    • You are solely responsible for ensuring your travel document including passport and/or entry/transit visas and health requirement are available and valid. We shall send you an itinerary copy by email for reference. If you are unable to receive the email within 24 hours, please contact us at once.

     

     

    • Flight Ticket

     

    • Flight tickets available through this Site are subject to the published conditions of carriage and rules, including but not limited to cancellation policies of the applicable airline. The contract of carriage in use by the applicable airline, when issued, shall be between the applicable airline and the passenger. Airline retains the right to adjust flight time and schedules at any time. Schedule change may result in an itinerary that falls outside of contractual agreements. Airlines may also in their discretion change or cancel flights or itineraries.

     

    • Your flight ticket comprises direct or connecting flights details. Please read all information carefully. Occasionally direct flights may require technical call en route for refuelling which will be stated in the flight ticket.

     

    • The 24-hour format will be used to display flight schedule based on local time, flight time (excluding taxi, parking, stopover and connecting time in transit) and aircraft types for your reference only. The information may be changed subject to onsite situation.

     

    • Flight ticket is valid only for air transportation shown on the itinerary commencing from the point of origin through the en route stopover (if any) to the final point of destination. Ticket must be travel in sequential order. If passengers do not show up for the booked flight without giving any prior notice, airline would cancel all return or onward bookings automatically.

     

    • You agree not to purchase a ticket or tickets containing flight segments that you will not be using. You further agree not to purchase a round-trip ticket that you plan to use only for one way travel. We shall not guarantee that the airline will honour your ticket or tickets if you engage in these practices. You agree to indemnify GoGoGo Travel against any airline claims, on the basis of these or any other prohibited practices, for the fare difference between the full fare of your actual itinerary and the value of the ticket or tickets that you purchased.

     

    • The terms for cancellation of bookings are varied subject to fare type, booking terms and individual airline policies. You agree to accept all cancellation, administration and services fees in full for any travel products or services booked but not utilized for any reason. Please be aware that cancellation of booking may not be allowed after ticket is issued subject to the relevant governing fare rules.

     

     

    • Check-in

     

    • Please bring with you the e-ticket copy as supporting document to facilitate check-in formalities at the airport.

     

    • GV (a ticket designator for governing special fare type such as companion fares) ticket holders may be required to check-in together with all group members for the same flight, subject to individual airlines’ policies.

     

    • Miscellaneous

     

    • Flight time is subject to the final approval of the Civil Aviation Authority.

     

    • Most of the airfares are not entitled to enjoy cumulative flight mileage benefits. Please contact the relevant airlines for detail.

     

    • The airlines’ latest edition for governing the terms of carriage applied.

     

    • We shall not assume responsibility for breaking or terminating your journey on your own, or failure to board the flight under any circumstances. Application for ticket refund in part or in whole will not be accepted.

     

    • In the event of outbreak of incidents such as natural disasters, political turmoil, epidemics or bad weather, passengers should pay close attention to the news broadcast or contact the airline to confirm whether the flight is on schedule, has been changed, cancelled or any other alternative arrangements. If the flight is on schedule, you will be required to check-in at the airport as normal. We are not responsible for any additional costs such as hotel accommodation and transportation etc. arising out of such incidents.

     

    • We shall not assume liability for any loss due to an act of negligence or the default of a Provider, directly or indirectly.

     

    • Once transaction for purchase of the Site Services is completed, we shall not accept any request for change, amend, cancel, transfer or refund of the Site Services.

     

    • In case of any dispute to the above terms, we reserve the right of final decision.

     

     

    1. Hotel Booking

     

    • Hotel Information

     

    • Through the Site, we provide an online platform through which booking arranger, user of the Site and/or hotel guest (collectively as “you”) can browse different types of hotel accommodation. You can make reservations at the price listed in accordance with the booking terms and conditions set out on the Site.

     

    • When you use the Services of the Site, the information that we disclose about hotel accommodations is based on the information provided to us by Providers through which Providers are fully responsible for updating all rates, availability, description, pictures, booking conditions, accommodation policies and other information which is displayed on the Site. Therefore we cannot guarantee all information is accurate, complete, correct or up to date although we shall use commercially reasonable skill and care in performing our services.

     

    2.2            Prices

     

    • Hotel prices listed on the Site are valid for foreign passport holders only (e.g. Hong Kong SAR Passport holders are not eligble for the prices of hotels in Hong Kong displayed in the Site). Please contact us for more information.

     

    • Occasionally cheaper promotional prices are available for a specific stay at a hotel. However these promotional prices offered by hotels may carry special restrictions and conditions governing cancellation and refund. Please read the booking terms carefully before making your booking. We shall not refund any price difference between the promotional price and the normal rate after booking transaction at the normal rate is made.

     

    • We endeavour to publish and maintain accurate prices and information for our services. Hotels provide us with the price and other information related to these services. In the event that a service is listed or provided to us at an incorrect price or with incorrect information due to incorrect service information given by hotels, typographical error, system error or other error in pricing, we reserve the right to refuse or cancel any booking orders placed for such service, whether or not the order has been confirmed and/or your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled due to incorrect information provided by the Provider, we shall promptly issue a credit to your credit card account in the amount of the charge.

     

    • Reservations

     

    • You may be restricted to cancel or amend your hotel booking subject to the booking terms.
    • Extra charges may occur

     

    • If you are unable to comply with the booking terms, we are not responsible for any charges incurred in connection with or arising out of any change of your hotel booking.

     

    • If you are unable to check-in your hotel for the first night but wish to retain the remaining period of stay for any reason, you must contact us to confirm the request at least one working day before the original check-in date to avoid cancellation of the entire booking.

     

    • If you do not confirm your request for any change of your hotel booking with us, the entire reservations may be cancelled. We shall process your refund application in accordance with the terms set forth for cancellation.

     

    • Booking must be made under guest’s full name in English identical with the travel document including but not limited to re-entry permit for staying in the Mainland.

     

    • The standard accommodation room reservations are for single and double occupancy. Request for extra bed, early check-in or late check-out will usually incur extra charges. Hotel may refuse to accept additional person staying in the same room. The hotel costs that you paid for will not be refunded.

     

    • If you wish to extend the period of stay, you must notify us by email at least three (3) working days prior to the check-in date. We shall contact hotel to extend the booking for a longer period of stay at the same price, if possible. Otherwise we shall not be liable if hotel charges a higher price than the original offer. Extension of stay cannot be guaranteed and price may be changed subject to hotel’s final confirmation.

     

    • Duplicate bookings will not be accepted, e.g. two rooms or two hotels for the same guest with same period of stay.

     

    • In compliance with the hotel reservations policy, we shall submit or reconfirm the guest rooming list seven (7) days prior to the check-in date. In this case your name would not be available in the hotel booking record before the processing period.

     

    • Hotel price and room booking may only be guaranteed against full payment. We accept VISA, MASTER and Unionpay for online payment.

     

    • Hotel will not accept booking for the purpose of wedding or recruitment.

     

    2.4   Group Reservations

     

    2.4.1      Hotel reservations for more than 8 rooms online staying at the same hotel with same period of stay may not be allowed.

     

    2.4.2      We reserve the right to cancel your reservations if we determine that you have booked reservations for more than 8 rooms under separate booking records and charge you a cancellation fee. Your deposit or prepayment will be forfeited if applicable. Please contact us for making group reservations for nine (9) rooms or more.

     

    2.5            Age requirement

     

    2.5.1      Hotels may not have a standard policy for age requirement. In general, guest on the booking should be over 18 years of age to check-in the hotel as contracts signed by minors are not legally enforceable.

     

    • Guests under 18 years of age are required to fulfil the following requirements:
    • Guest under 15 years of age must be accompanied by parent or guardian;
    • Age between 15-18 years: if guests are travelling alone, their parent or guardian might be required to sign a written consent e.g. notarized permission and in possession of applicable travel insurance.

     

    • Age requirement in different countries are varied. If hotel refuses to accept the booking, we shall cancel the booking in accordance with the hotel policy.

     

    2.6            Special requests

     

    2.6.1      Hotel room assignments are at hotel’s sole discretion based on room availability of the day. We are not responsible and cannot guarantee any special requests or preferences for including but not limited to early check-in, late check-out, smoking or non-smoking room, bedding (twin or double bedded), floor location, pet accommodation or adjoining rooms. Additional charges for any special requests may be applied. We shall not accept any request for refund, in part or in whole if hotel is unable to fulfil your special request under any circumstances.

     

    • No refund for late check-in and/or early check-out.

     

    2.7     Payment

     

    2.7.1      All hotel rates are quoted in Hong Kong Dollar (HKD) per room per night or the total amount inclusive of room rate, taxes and service fee for the entire period of stay. We accept VISA, MASTER and UnionPay credit cards only for online hotel payment.

     

    • You may be given the option to make post payment for your hotel booking which will be charged in local currency directly by the hotel during your stay. The Site displays the currency in HKD is an estimation of the converted amount, the actual rate may vary. Please note that exchange rates fluctuate from time to time, we shall not accept any responsibility for any discrepancy in currency conversion.

     

    2.8   Check-In:

     

    2.8.1      In receipt of the full payment, we shall send a hotel voucher (for room only, the exact period of stay and number of people indicated, breakfast may not be included unless specified) to you via email which will be served as supporting document for hotel check-in.

     

    • In general, hotel room check-in time starts from 15:00 and will be reserved until 18:00 on the day of arrival; check-out before 11:00.

     

    • Upon check-in, guests must present valid travel document and credit card (as deposit for any sundry expenses during their stay) under their name that is consistent with the booking details.

     

    • Please settle all other expenses such as urban construction fee, baggage handling fee, housekeeping fee, mini bar charges, phone calls, transport, internet, movie rental and/or energy surcharges etc., if applicable, before leaving the hotel.

     

    2.9     Disclaimer

     

    2.9.1      This Site is for your personal and non-commercial use. We offer the Site as a platform to book hotel rooms. All parties agree that the Site does not in any case constitute an agent of the hotel, booking arranger or the hotel guest.

     

    • You must apply for relevant entry visa on your own, if required. We reserve the right at our sole discretion to turn down visa application for and on your behalf.

     

    • The approval of entry visa is solely determined by the consulates of all countries. We are not responsible for any problem in relation to or arising out of your entry visa.

     

    • If the relevant authority refuses the hotel guest to enter the country, we are not responsible for any expenses including but not limited to accommodation, food and transportation incurred by the hotel guest. We shall not refund or pay any compensation to the hotel guest. Change of hotel booking including number of rooms, guest name and period of stay will not be allowed.

     

    • In the event of a traffic accident or delay, loss of baggage, accidental injury or property damage, you are required to contact the Provider directly for compensation.

     

    • We shall not assume liability for any injury, damage, death, loss, accident or delay due to an act of negligence or the default of a Provider.

     

    • We shall not responsible for any services and room assignment provided by the hotel. The contract of accommodation in use by the hotel shall be between the hotel and the hotel guest. Please address your concern directly to the hotel whenever necessary.

     

    • All content posted on the Site, including but not limited to hotel rating, room types and hotel location, is provided by hotels or its affiliates. We do not warrant and disclaims any liability for the accuracy or completeness of the information provided by Providers in relation to their products for the authenticity of the hotel information or the photo of the hotel premises.

     

    • Some countries do not have auditor or official unit to provide a hotel rating system, or the system available is unclear to assign star rating. The hotel star rating system may not be consistent in different countries.

     

    • We shall not liable for any claims against any error, omissions, discrepancies, non-fulfilment or unsatisfactory fulfilment of products and services purchased on your behalf by the Site from the third party providers including but not limited to hotel and its affiliates, tour operators, car hire companies, insurance companies and other entities.

     

    • No warranty or guarantee is made regarding the completeness, accuracy, reliability or quality of any information, content, data, service, advice or merchandise provided or available through this Site.

     

    • We do not assume any responsibility for any loss incurred during the stay of the guest in the hotel.

     

    • We reserve the right at our sole discretion to change any information on the Site at any time without prior notice.

     

    1. Indemnity

     

    You agree to fully defend and indemnify the Site from and against any legal action, legal process, claim, penalties or other costs or expenses of any kind or nature, judgement or damage arising out of or in connection with any breach of or failure to perform any of the undertakings, warranties or obligations under this Terms.

     

     

    1. Promotion Code

     

    • The Promotion Code (the “Code”) is applicable for flight and hotel payments online through the Site only. The Code cannot be used in combination with other promotions.

     

    • The Code must not be used for completed bookings. The Code is valid for unpaid orders only.

     

    • The Code does not apply to taxes, administration fees, penalties for cancellation, amendment or other fees. You are fully responsible for the total costs.

     

    • The Code does not bear any cash value, nor it offers any refund or cash alternatives. Any misuse of the Code including but not limited to the issuance or sale of the Code may constitute a fraud.

     

    • The use of the Code is bound by general booking terms and conditions. All bookings for flights and hotels are subject to availability and price changes.
